orgnotes, mp3s and how to do the lockdance

So when a moderator goes asking "to be orgnoted" in a thread where links to the latest mp3 are being passed around it's cool?

But when joe orger does the same thing in the same thread lockdance

Certain orgers simply said "send me an orgnote" just like a certain moderator.

One thing is whether things like the audio to the Brits performance is legal to pass on or not. It was free to listen to on at least 2 websites, but these were real-time streaming audio and you can't re-link to them to hear them again. The law usually turns a blind eye to recordings for personal use - it is only when you pass them on that it becomes unlawful. So strictly speaking, asking for the audio comes under the Org rules of not soliciting for bootlegs, I guess.

However, fact is there is hardly an Orger who hasn't technically broken the law by hearing/possessing/sharing bootlegs at some time or another - discussing these things practically keeps the site going, and you can't discuss it unless you've heard it. Certainly there is a huge demand simply to hear this performance right now.


The name of the game, really, is keeping it all on the downlow so that the Org doesn't attract the attention of Prince's lawyers. After all, if you want to keep it a completely lawful place you shouldn't really have pics posted where the permission hasn't been obtained, which clearly happens. In that case, I think keeping it subtle by orgers casually asking for an orgnote without being too blatant in their soliciting should probably be allowed. Orgers who are too blatant about it should be warned to be more subtle in future.

It's a tough job being a moderator and you are far more likely to upset people down the line than make them happy!

Is it really "illegal" to talk about or request an mp3 of a performance that was just on broadcast TV in the UK (or anywhere else in the world, including the US)?

I thought it was rather silly to see almost nothing but posts telling me not to ask for an mp3 after the SNL performance, and now it's the same thing all over again. Shoot, I hadn't even thought about an mp3, but after reading over and over that there was to be no discussion or requesting of said mp3...then I wanted it! smile Who doesn't wanna listen to Prince in their car, after all?

Prince doesn't own the recording of that performance (of either the SNL or the Brit Awards performances, I should say), so I'm curious as to how this rule was determined and by whom. It doesn't really give you that "online fan community" vibe when you know that the mods and the regulars are all passing the mp3 around but little ol' you cain't have it.

Oh well, at least the video should be up on Housequake soon.

in the case of prince, yes...because he has threatened lawsuits in the past its not worth the chance.
